Social and Human Rights

This aggregate criterion summarises the RMAP Facility Standard Social and Human Rights sub-criteria. Its conformance is derived from the rollup of the sub-criteria listed below.

Sub-Criteria

  • Community Health, Safety and Development — Policy commitments and action plans to prevent adverse impacts on community health and safety, establish baseline conditions for community development, and promote local employment and procurement
  • Rights of Indigenous Peoples — Where Indigenous Peoples may be affected by Facility operations: policy commitment to FPIC, separate meaningful engagement, baseline conditions, and action plans respecting traditional lands, knowledge, and decision-making
  • Land Acquisition and Resettlement — Policy commitment to respect land rights, minimize resettlement, and where unavoidable, implement Resettlement Action Plans ensuring equitable compensation and livelihood restoration
  • Cultural Heritage — Where cultural heritage may be affected: policy commitment, baseline identification and mapping, chance find procedures, action plans to prevent adverse impacts, and continued stakeholder access to cultural heritage sites
  • Child Labor — Policy prohibiting child labor in alignment with ILO C138 and C182, verification mechanisms, action plans for young workers, immediate remediation upon identification, and grievance mechanisms
  • Forced Labor — Policy prohibiting forced and bonded labor in alignment with ILO C029 and C105, action plans prohibiting debt bondage, retention of documents, recruitment fees, and coercion, with grievance mechanisms
  • Freedom of Association and Collective Bargaining — Policy commitment to respect workers' rights to freedom of association and collective bargaining in alignment with ILO C087 and C098, with protections against reprisals for union participation
  • Employment Terms — Written employment agreements in workers' language covering all terms and conditions, policy commitments to fair employment, legal right to work verification, and maintenance of employment records
  • Working Hours — Monitoring of working hours to ensure regular hours do not exceed 48 hours per week and overtime does not exceed 12 hours per week, with voluntary overtime, rest periods, and special provisions for pregnant workers and young workers
  • Remuneration — Payment of wages meeting or exceeding national minimum wages and industry rates, action plans for living wages, premium overtime pay, social benefits, transparent pay slips, and prohibition on wage deductions for disciplinary purposes
  • Use of Labor Providers and Agencies — Use only legally registered labor providers and monitor agencies to ensure no recruitment fees charged to workers, compliance with working hours, and prohibition of forced and child labor
  • Discrimination and Harassment — Policy prohibiting all forms of discrimination and harassment in alignment with ILO C111, action plans with standardized disciplinary procedures, investigation of all cases, and training for workers
  • Diversity, Equity and Inclusion — Policy commitments to promote DEI and gender equality in the workplace, assessment of barriers to diversity, action plans to address barriers, and grievance mechanisms inclusive and culturally appropriate for all worker populations
