Overview
Written employment agreements in workers' language covering all terms and conditions, policy commitments to fair employment, legal right to work verification, and maintenance of employment records.
Requirements
The Facility shall:
- 9.8.1 Ensure that all workers (including those employed by contractors) are provided with a written employment agreement in a language understood by the worker that contains a description of terms and conditions of employment.
- 9.8.2 Establish a documented policy that includes commitments to:
- 9.8.2.1 Respect workers' rights to fair and decent employment terms, including entitlement to work, hiring, remuneration, and working hours.
- 9.8.2.2 Meet or exceed legal minimum wages and provide paid holidays in consideration of ILO Conventions C131, C095 and C132.
- 9.8.2.3 Respect limits to working hours and overtime and provide adequate period of rest in consideration of ILO Conventions C001 and C014 and applicable exceptions.
- 9.8.2.4 Provide adequate and decent accommodation, as applicable, with consideration of ILO Recommendation R115 on Workers' Housing.
- 9.8.3 Develop and implement mechanisms to verify during the hiring process that all workers have the legal right to work in the country where the Facility, or operation, is located.
- 9.8.4 Maintain employment records to demonstrate legal right to work for all of the workforce.
